Purpose and Scope
This Major Disruptive Events Policy forms part of the Peer Creators Policy Pack and is incorporated by reference into the Terms of Use and Conditions. Its purpose is to define the limited circumstances in which an event outside the parties' reasonable control will excuse performance of a Booking, and to set out the consequences, claim procedure, and evidence requirements.
This Policy is the exclusive source for determining whether a Major Disruptive Event ("MDE") has occurred. Where this Policy conflicts with or differs from the general force majeure clause in the Terms of Use (Clause 22.6) or the cancellation rights in Section 10 of the Cancellation and Refund Policy, this Policy prevails. All Users are bound by the determination procedure and consequences described below.
This Policy applies to all confirmed bookings made on or through the Peer Creators Platform, including bookings for spaces, creator services, and bundled bookings. It applies to Clients, Space Hosts, Creator Pros, and their invitees, crew, and subcontractors. For the purposes of this Policy, "Company", "we", "us" or "our" means Peer Creators FZ-LLC; "Booking" means a confirmed reservation for a space, service, or bundle; and "Platform" means the Peer Creators website and related services.
Qualifying Major Disruptive Events
A Major Disruptive Event is an event or circumstance that (a) is outside the reasonable control of the Client, Host, and Creator; (b) occurs after the Booking is confirmed; (c) makes performance of the Booking impossible, unsafe, or unlawful; and (d) is supported by the evidence threshold set out below. The following categories are the only events that may qualify as an MDE under this Policy.
2.1 Government restrictions and permit revocation
A government order, law, regulation, or directive that prohibits the activity or the use of the booked space or creator services for the booked date or time. This includes lockdowns, curfews, venue closures ordered by a competent authority, or revocation of a permit that was required for the booking.
Evidence threshold
Government gazette, official notice, permit revocation letter, or police/civil defence order citing the specific booking or a general prohibition covering the booking period.
2.2 Public health emergencies
A declared epidemic or pandemic, or a public health emergency declared by the UAE Ministry of Health and Prevention, Dubai Health Authority, or a similarly competent national or international health body, that makes holding the booking unsafe or unlawful.
Evidence threshold
Official public health declaration, isolation order, or government guidance specifically prohibiting gatherings or production activity of the booked type during the booking window.
2.3 Severe weather (UAE NCM red/orange alert or equivalent)
A weather event for which the UAE National Centre of Meteorology (NCM) issues a red or orange alert, or an equivalent warning from a recognised national meteorological authority, that covers the booking location and period and makes the booking unsafe or impossible.
Evidence threshold
Official NCM alert screenshot or report showing the alert level, location, and timing; or a local police/civil defence advisory to avoid non-essential travel or outdoor activity.
2.4 Critical infrastructure failure
A failure of power, water, telecommunications, major transport links, or other critical infrastructure that prevents the booked space or creator services from being usable and is not caused by the Host, Creator, or Client.
Evidence threshold
Utility outage map, service provider outage confirmation, government transport authority notice, or civil defence report showing the failure and the affected area/period.
The Company may also consider an event that falls outside these categories but is substantially similar in nature and impact. Any such determination is at the Company's sole discretion and must be supported by official evidence equivalent to the thresholds above.
Events That Do Not Qualify
The following events, circumstances, and consequences are not Major Disruptive Events under this Policy, even if they are unforeseen, inconvenient, or financially significant. A claim based on any of these grounds will be denied.
Personal illness of the Client, Host, Creator, or any crew member, unless the illness is accompanied by a government-issued quarantine order or public health directive that applies to the booking.
Transportation difficulties, traffic, flight delays, visa issues, or missed connections that are not caused by a qualifying infrastructure failure or government closure of transport.
Crew or talent unavailability, including no-shows, cancellations by subcontractors, or scheduling conflicts.
Changes in business or financial circumstances, budget shortfalls, or a Client's decision not to proceed for commercial reasons.
Weather that does not meet the applicable alert threshold (for example, yellow NCM alerts, rain without an alert, heat without a red/orange warning, or ordinary sand/haze).
General economic conditions, market downturns, or changes in demand that are not specific to the booking.
Regulatory changes that do not directly prohibit the specific booking or the specific use of the booked space or services.
Disagreement between the parties about styling, timing, creative direction, or budget is not an MDE. Those disputes are handled under the Dispute Resolution Policy.
Consequences of an MDE
If the Company determines that a Major Disruptive Event has occurred, the following consequences apply automatically, unless the Client and Host (and Creator, if applicable) agree otherwise in writing through the Platform:
- Full refund to the Client: The Client receives a refund of 100% of all amounts paid for the affected Booking, including the rental or service fees, deposits, and any Platform Fees. The refund is processed within 10 Business Days of the determination, using the original payment method where possible.
- No Host or Creator penalty: Neither the Space Host nor the Creator will be penalised for the cancellation, and any cancellation-related fee or rating impact that would otherwise apply under the Cancellation and Refund Policy is waived for the affected Booking.
- Rebooking option: The Client may, at their option and subject to the Host's or Creator's availability, rebook the same space or service for a mutually agreed date. Any price difference between the original and rebooked date is charged or refunded as applicable. If rebooking is not possible, the refund option applies.
The Company will communicate the determination, refund instructions, and rebooking options to all parties through the Platform and by email to the addresses registered on their accounts.
Claim Procedure
To obtain MDE treatment, the affected party must submit a claim through the Platform within the deadline and with the required evidence. Claims made outside this procedure may be delayed or denied.
- 72-hour deadline: The claim must be submitted within 72 hours of the qualifying event, or before the scheduled booking start time, whichever is earlier. Late claims are generally not accepted unless the claimant can demonstrate that earlier submission was impossible.
- Evidence requirements: The claimant must attach official evidence corresponding to the evidence threshold for the relevant qualifying event. Screenshots, photos, news articles, or third-party blogs are not sufficient unless they directly reproduce an official notice or alert.
- Company determination: The Company will review the claim and evidence within 2 Business Days for standard bookings and 1 Business Day for High-tier or Event-Mode bookings. The Company may request additional information and may consult official sources.
- Determination is final: The Company's determination whether an MDE has occurred is final and binding on all parties for the purposes of this Policy. It does not affect a party's rights to seek relief under the Dispute Resolution Policy for separate legal claims, but the MDE determination itself is not subject to dispute or arbitration.
Amendments and Integration
The Company may amend this Policy from time to time. Material amendments are published on the Platform with a revised version number and effective date at least 15 days before they take effect. Amendments do not apply retroactively to confirmed bookings; the version in effect at the time of booking confirmation governs that Booking.
This Policy is an integrated part of the Peer Creators Policy Pack, together with the Terms of Use (Clause 17.2), Cancellation and Refund Policy (Section 10), Insurance and COI Requirements Policy, Trust, Safety, Reporting and Enforcement Policy, and the other Incorporated Policies. In the event of any inconsistency, this Policy prevails over any other Incorporated Policy on the question of whether an MDE has occurred and what the consequences are.
