Purpose and Scope
This Damage, Deposits and Claims Policy forms part of the Peer Creators Policy Pack and is incorporated by reference into the Terms of Use and Conditions. It sets out the rules for the collection, holding and release of security deposits, the creation and evidentiary status of digital condition records, and the procedure for filing, evaluating and resolving damage claims relating to Bookings on the Peer Creators marketplace.
For the purposes of this Policy, "Host" means the Space Host or Creator Pro listing the space or service; "Client" means the guest or customer making the Booking; "Company", "we", "us" or "our" means Peer Creators FZ-LLC; and "Business Day" means a day (other than Friday, Saturday or a public holiday) on which banks are open for general business in Dubai, UAE.
Security Deposit Collection and Authorisation
A Host may elect to require a security deposit for a Listing. The deposit amount is calculated as a percentage of the Booking subtotal (excluding add-ons, travel fees, service charges and taxes) and is displayed to the Client before checkout. The Client must expressly authorise the deposit hold as part of the checkout process.
Hosts choose from the following three tiers:

The security deposit is collected as a pre-authorisation hold on the Client's payment card at the time of Booking confirmation, not as a separate charge. Peer Creators uses a licensed payment processor to place and hold the authorised amount. The hold may remain on the Client's account for up to 45 days from the date of checkout, although it is typically released much sooner if no claim is filed.
The deposit is not a premium, insurance policy or guarantee of coverage. It is a security mechanism to facilitate the swift resolution of minor damage claims without requiring full litigation. If the damage exceeds the deposit amount, the Host may still pursue the balance under the liability and dispute provisions below and in the Terms of Use.
Condition Record and Check-in / Check-out
For every Booking that includes a security deposit, the Host must generate a digital condition record through the Peer Creators platform. The record must be created at or before check-in and updated at check-out. The condition record should include:
- Timestamped, geotagged photographs of the space or equipment from multiple angles;
- A plain-language description of existing marks, scratches, wear, defects or pre-existing damage;
- Confirmation of any provided furniture, equipment, props or fixtures and their apparent condition; and
- The identity of the parties present at check-in and check-out, if applicable.
Photographs should be taken in good lighting, in focus, and from consistent vantage points at both check-in and check-out so that a direct comparison can be made. The Host must upload the check-in condition record through the platform before the Booking begins. The Client is encouraged to review the record and may append their own photographs or comments within 30 minutes of check-in.
The condition record is intended to be the primary evidence of the state of the space or equipment at the start and end of the Booking. If the Host fails to create and upload a check-in condition record, any later damage claim by the Host will be presumed to relate to pre-existing condition unless the Host can provide independent, timestamped evidence that the damage occurred during the Booking period.
Damage Claim Procedure
If a Host believes damage occurred during a Booking, the Host must file a damage claim through the Peer Creators platform no later than 48 hours after the Booking's scheduled check-out time. Late claims may be rejected at the Company's discretion unless the Client agrees otherwise in writing.
A complete damage claim must include:
- A description of the alleged damage, including when and how it was discovered;
- Timestamped photographs comparing the check-in condition record to the check-out condition record;
- Repair or replacement receipts, quotes, or invoices from a qualified third party, where applicable;
- An estimate of the loss or repair cost; and
- Any other evidence the Host wishes the Company to consider.
Upon receipt of a complete claim, the Company will notify the Client and provide a copy of the submitted evidence. The Client has 72 hours from the date of notification to respond. The Client may:
- Accept the claim and authorise release of the deposit to the Host;
- Dispute the claim and provide counter-evidence; or
- Request additional information from the Host.
If the Client disputes the claim, the parties may attempt to resolve the matter through the Peer Creators dispute resolution process described in the Dispute Resolution Policy. Failure by the Client to respond within the 72-hour window will not automatically result in a decision in favour of the Host; the Company will still evaluate the claim against the evidence on file.
Damage Claim Evaluation
The Company will evaluate damage claims based on the evidence submitted by both parties, the condition record, and any additional information reasonably requested. In evaluating a claim, the Company will consider:
- Whether the damage is new and occurred during the Booking period;
- Whether the damage is proportionate to the use permitted under the Booking;
- Whether the damage is pre-existing and documented in the check-in condition record;
- Whether the repair or replacement costs are reasonable and supported by third-party evidence;
- Whether the Host took reasonable steps to mitigate the loss; and
- Any other relevant facts or circumstances.
The Company may deduct from any claim an amount attributable to fair wear and tear, pre-existing damage, or the Host's failure to mitigate. The Company may also engage an independent assessor where the value or complexity of the claim warrants it. The Company's determination is binding on the parties for amounts within the deposit ceiling set out below, subject to the dispute resolution process for amounts in excess.
Security Deposit Release
If no damage claim is filed by the Host within 48 hours after the Booking's scheduled check-out, the security deposit hold will be released automatically within 5 Business Days after the check-out date, unless the release is delayed by the Client's payment provider or bank.
If a damage claim is filed and the Client accepts the claim, the authorised deposit amount will be charged and released to the Host in accordance with the agreed settlement, net of applicable processing fees, within 5 Business Days of acceptance.
If a claim is disputed or under evaluation, the deposit hold may remain in place until the dispute is resolved or the Company issues a determination, up to the maximum 45-day hold period. If the Company determines that no amount is payable to the Host, the deposit hold will be released within 2 Business Days of the determination.
Liability Allocation for Damage Claims
The Client is liable for damage caused to the Listed space, equipment, fixtures, props or furnishings by the Client, their invitees, or any third party present at the Client's direction during the Booking period. The Client is not liable for:
- Damage caused by the Host, the Host's staff, or the Host's contractors;
- Damage resulting from a pre-existing defect or failure of the Host's equipment or premises;
- Damage caused by force majeure events or matters beyond the Client's reasonable control; or
- Fair wear and tear resulting from ordinary use of the space in accordance with the Booking.
Hosts are responsible for maintaining their spaces and equipment in a safe and serviceable condition, for providing accurate condition records, and for ensuring that any rules communicated to the Client are reasonable, lawful and clearly stated in the Listing or Booking confirmation.
Damage Claim Ceiling
The maximum amount recoverable from the security deposit for a single damage claim is the lower of: (a) the actual, reasonable and documented cost of repair or replacement; and (b) the amount of the authorised security deposit hold for that Booking.
Where the Host's documented loss exceeds the deposit amount, the Host may pursue the excess amount from the Client directly, or through the dispute resolution process or other lawful means, provided the Host has complied with the claim procedure and condition-record requirements in this Policy. Peer Creators does not guarantee recovery of any amount beyond the deposit hold and is not a party to any separate legal action between Host and Client.
Fraud and Abuse
The Company takes a zero-tolerance approach to fraud and abuse in the damage claims process. The following conduct may result in suspension or termination of the offending user's account, forfeiture of claims, and referral to law enforcement or other authorities where appropriate:
- Inflated or fabricated claims for damage that did not occur or was exaggerated;
- Staging damage or tampering with evidence, photographs or condition records;
- Retaliatory claims filed primarily to punish, harass or coerce another user;
- Knowingly providing false or misleading information during a claim evaluation; and
- Repeated failure to comply with the condition record or claim procedure requirements.
Users may report suspected fraud or abuse through the reporting tools in the Peer Creators platform or by contacting the Trust & Safety team. Reports are handled under the Trust, Safety, Reporting and Enforcement Policy.
Amendments
Peer Creators may amend this Policy from time to time. Material changes will be communicated by posting the updated Policy on the platform and updating the version number and effective date. If a change materially affects a pending Booking or active claim, the version in effect at the time of Booking confirmation will generally apply, unless the change is required by law or is clearly beneficial to the affected party.
